The case involving police inspector Dattatraya Temghare, affiliated with the anti-organised crime cell (south region) of the crime branch in Pune, is set to reach its climax as his anticipatory bail plea comes up for its conclusive hearing on February 22.
This plea pertains to allegations of causing grievous harm to gangster Bandu Andekar in 2009.
Interim Relief Granted Earlier
Following the registration of a complaint against Temghare and assistant police inspector Sunil Shinde, the former secured interim bail.
The anticipatory bail application included the state of Maharashtra and the Samarth police station as parties.
The Samarth police station submitted a response stating that they hadn’t lodged a complaint against Temghare since the purported incident had occurred in Hadapsar.
Legal Perspectives Presented in Court
During the recent hearing of the anticipatory bail plea, Bandu Andekar’s Lawyer Bilal Shaikh, presented his stance before additional sessions judge S S Mahajan.
Shaikh argued that the plea couldn’t be upheld under section 438 of the CrPC, as it was the court itself that initiated prosecution against Temghare, rather than the police.
He further contended that Temghare might manipulate the prosecution’s evidence, given the existence of preliminary evidence against him.
Awaiting a Comprehensive Hearing
Vaishali Chandane, the Lawyer for Inspector Temghare, has requested an extension until February 22 to present arguments in favor of the anticipatory bail plea.
The case was instigated when Andekar displayed flex boards within the jurisdiction of the Samarth police station, denouncing Temghare for purportedly perpetrating atrocities against his family.
Andekar’s arrest transpired on February 21, 2009, with complaints emerging of mistreatment when he was produced in court the subsequent day.
An inquiry, commissioned by the then chief judicial magistrate, R H Mohammad, revealed that Andekar had suffered a fractured leg, implicating the policemen in question.
