Pune Gangland: Gangster’s Deceptive Bail Claim Exposed, False Medical Reports Used to Secure Bail

A notorious gangster’s attempt to secure bail using fabricated medical reports claiming he required cancer treatment and was at high risk due to the pandemic has been exposed by Shivajinagar police. Nilesh Baswant (35), a close associate of infamous gangster Bapu Nayar, presented fake medical documents to the Supreme Court in September, leading to his release.

A recent public appearance and meticulous police scrutiny of his submitted documents unraveled the deceitful strategy.

Fabricated Claims

Baswant, a member of Bapu Nayar’s organized crime syndicate, managed to obtain bail through the ruse of medical grounds, taking advantage of the ongoing pandemic.

His purported vulnerability due to cancer treatment provided the basis for his plea.

Nevertheless, his subsequent conspicuous presence in public contradicted his supposed medical condition, prompting Shivajinagar police to delve into his case and uncover the fraudulent tactics.

Legal Consequences

The Shivajinagar police have registered a case against Nilesh Baswant for cheating and forgery, with efforts underway to present the evidence of his deceit to the Supreme Court in order to have his bail revoked.

Baswant’s association with the gang led by Bapu Nayar adds to the complexity of his legal entanglement.

Investigative Measures

Senior Police Inspector Vinayak Gaikwad of the anti-narcotics cell was assigned by Assistant Police Commissioner (ACP) Surendra Deshmukh to probe the authenticity of the medical documents submitted by Baswant.

Upon scrutiny, it was discovered that the medical reports had been fraudulently acquired from a doctor in Satara.

ACP Deshmukh highlighted the steps taken by the police, saying, “We cross-checked the reports with the doctor whose letterhead was used by Baswant, but he told us that he did not issue the same. We are investigating how he obtained the reports and who assisted him in this matter. We will present a comprehensive report to the Supreme Court, seeking the cancellation of his bail due to his misleading actions.”

Bold Public Display

In an ironic twist, Baswant’s undoing came when he was spotted publicly mingling with associates, flaunting his freedom, despite his supposed medical vulnerability.

Notably, he was captured on video roaming the premises of the Pune Municipal Corporation, accompanied by a large group.

The gangster’s participation in political activities, such as his mother’s appointment to the women’s cell of the Nationalist Congress Party (NCP), was documented and shared on social media platforms.

This audacious display raised questions about the authenticity of his claimed health condition and his integrity in securing bail.

Ongoing Investigation

In light of these revelations, the crime branch is now conducting an investigation into Baswant’s brazen public appearances and the implications of his fraudulent bail claim.

The case underscores the police’s commitment to scrutinizing and exposing deceptive strategies employed by criminals seeking legal leniency.

Bapu Nayar Gang Members Charged Under MCOCA

The Bapu Nayar gang, led by the notorious criminal Bapu Nayar, has been hit with charges under the Maharashtra Control of Organised Crime Act (MCOCA).

Nayar, a prominent figure within the gang, has amassed a record of 15 serious criminal offenses, ranging from murder to robbery and dacoity. His accomplice, Baswant, also bears a history marred by seven serious crimes registered against his name at Sahakar Nagar, Hinjawadi, and Kondhwa police stations.

The duo was apprehended and imprisoned for their involvement in coercing a Kondhwa family and forcibly evicting them from their property.

Incident and Criminal Proceedings

An incident in December 2015 led to an FIR filed with the Kondhwa police by Nilesh Botra, a 39-year-old resident of Parvati.

The complaint implicated Nayar, Baswant, along with Deepak Krishna Kadam and Amol Baswant. Botra alleged that his wife and her sister owned a parcel of land in Kondhwa Budruk, which the accused were attempting to seize.

Nayar reportedly issued threats to the family, and Baswant extorted Rs 6 lakh from them under duress to maintain their occupancy on the property.

The complainant also claimed to have been threatened with death.

Legal Pursuits and Arrests

Following the complaint, police intervention led to the apprehension of Kadam, while Nayar, Baswant, and others managed to evade capture.

A tip-off received by police constable Amol Pawar, affiliated with the anti-extortion cell, led to the arrest of Nayar and Baswant in Delhi during August 2016.

The duo was subsequently confined to the Yerwada Central Prison.

Baswant was granted temporary release by the Supreme Court for medical reasons in April 2020, but his quest for bail on the grounds of cancer treatment was denied by the sessions court in July 2020.

Alleged Deception and Bail Decision

Undeterred, Baswant resorted to submitting forged medical reports to the Supreme Court. His legal counsel argued that his client was battling cancer, and given the challenging COVID-19 situation, regular bail should be granted for essential medical treatment.

The defense emphasized the prolonged period of imprisonment and the relatively modest amount involved in the case, contending that Baswant should not remain incarcerated.

Relying on the presented medical documents, the court extended bail to Baswant.

Subsequent Legal Proceedings

Recently, the Shivajinagar police booked Baswant under various sections of the Indian Penal Code, including charges of cheating, forgery, and using false certificates.

The crime branch has initiated an investigation into the case, indicating the determination of law enforcement to unravel deceptive actions and maintain the integrity of legal proceedings.
